Wrongful Death Action - A wrongful death action is brought against the defendant to recover damages for the death of a person that was caused by neglect, unlawful violence, negligence of another or a wrongful act. This can only be done if recovery for damages was not claimed by the deceased during their lifetime.

Wrongful Death Statute - The wrongful death statute is a statutory law that is the means for a representative of a deceased person who can allege that the death of the person was caused by someone's negligence, willful or negligent act and allows that person to seek compensation for monetary loss they've suffered because of the death.
