One of the most important factors of an asbestos-related lawsuit is the filing process. While it may seem simple enough to file a lawsuit, many victims are so concerned with their health that they wait to even ponder filing a lawsuit. Quality of health should certainly be of top concern in any medical case, but keep in mind that the statute of limitations must be met in order to file suit.

The statute of limitations differs from state to state, but in general, most states allow one to two years to file suit. Be aware that the statute of limitations applies whether filing a personal injury suit or a wrongful death suit on behalf of a relative.

The first step in a successful filing process is finding an asbestos or mesothelioma lawyer. Working with a lawyer who has experience in asbestos-related cases is most advantageous, as the whole process will proceed with greater efficiency. The filing process will start with the potential legal team asking questions about your case. Be prepared to talk about past employment, health history, and current health status. The location of where the case is filed can make a difference in the amount of time the case process will take. Depending on your current location, you may have to file suit in a different state. What is required to file? The filing process requires a lawyer to fill out paperwork for the court, which is also sent to the person or corporation being sued. This paperwork is called the complaint or the petition. In most cases, the petition wholly accuses the defendant of being responsible for your illness or the death of a loved one.

The defendant has a set amount of time to read and respond to the initial claim. In some cases, you will be offered a settlement right away, but the defendant may reply in opposition to the claim. Legal teams then take part in the discovery process, a trial date is set, and the case will either be settled or taken to trial.
