Mesothelioma Legal FAQs - Smoking and Mesothelioma

Some victims of mesothelioma are under the impression that they cannot file a lawsuit against the companies that produced asbestos products because they smoked. However, this is not the case, as individuals who smoked and are now suffering with mesothelioma can still launch a legitimate court case.

Mesothelioma is caused almost exclusively by asbestos exposure-not smoking. Another factor in liability is the fact that asbestos companies knew safety precautions such as face masks could limit asbestos exposure and hazards for individuals who worked with the material. Despite this knowledge, the companies made no effort to employ any safety measures.

Smoking does not increase an individual's chance of contracting mesothelioma. No amount of smoking can cause this type of asbestos cancer. The only proven cause of mesothelioma is asbestos exposure.
