Why Is a Legal Claim a Better Option Than Seeking Workers' Compensation in Mesothelioma Cases?
Mesothelioma lawyer Daniel Wasserberg of Meirowitz & Wasserberg explains why a legal claim is a better option than seeking workers' compensation in mesothelioma cases.
Workers' compensation is really designed to protect business. It's a form of insurance that allows businesses to not get sued by their employees. Okay? It might be fine. If you have a back injury, or God forbid, you got a finger chopped off on the job. You know, something that you can live with and you can go but when you get mesothelioma from a whole career of working with asbestos, you know, we're talking about a different level of compensation. We're not talking about, two thousand dollars a month in in in benefits. What we do is we go after what we call third party defendants. But that really just means the manufacturers of asbestos containing products, the companies that sold or supplied those products the companies that utilize those products and their equipment, the companies that used them on their premises, the contractors that installed them on those premises. So you may say, Hey, I worked for company X my whole life. That's who I need to go after. But actually, it's gonna be everything under that company that is responsible for all of the asbestos that caused you to get sick. And, you know, if you're worried about suing your employer, the truth is in all probably ninety nine percent of our cases we don't sue the employer. If there's a loophole in the law or a special law created that allows us to sue the employer, we will, as long as you give us the permission to do so.
